Tomorrow morning, I will begin the fourth day of trial. My best guess is that we'll get to the closing arguments by noon and the jury will deliberate after lunch. We've already lost a few major battles with the judge, so I'm not too positive about the ultimate decision by the jurors.
Let's see, the judge allowed the state's expert to testify as to the truthfulness of our client's testimony in violation of rule 702. The judge denied our motion for a directed verdict despite a defective pleading which did not allege a violation under the statute. Finally, we got a little smack down on entering evidence that would have shown some family support.
I don't want to go into many specifics because it's not over yet but those are a few of the frustrations.
